The US Constitution - Here Is What It Says

By: Don Thayer

There is no Constitutional provision for "original intent" or judicial interpretation. Although it was written over two hundred years ago using archaic terminology, there is no real ambiguity about the meaning of the text. This book emphasizes that text as written....

Article 1, Section 8: "Section 8 of Article 1 deserves some extra time and discussion. Each clause delegates a specific power to the federal government. The first clause begins with “The Congress shall have Power To,” and each clause adds an additional power of Congress. These powers apply only the federal government, not the states." "The relevance of this section is in relation to the rest of the Constitution, as well as the Bill of Rights. The Tenth Amendment states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”. In other words, if the power is not specifically named as a United States power, it is reserved for the individual states or the people."...

Flare: Opinions (Law, Human Rights and Politics)

By: Ankur Mutreja

Opinions are like flare, which can turn either way: they can spread like wild fire or encapsulate themselves within the bounds of personal integrity, and thus illuminate. I started writing opinions in the late 2008 through my blogs. I admit at times I did go wild with unsubstantiated accusations and surmises, leading to risky speculations and irresponsible opinions. Recently, I published a comprehensive book of my writings entitled "Writings @ Ankur Mutreja", and the present book is a short selection of my opinions presented therein with emphasis on responsible writing. I am an advocate by profession; therefore, most of my opinions have a tint of law; in the first part, the expression is simple; so, it is for lay persons who won’t mind a little exercise of mind in the legal arena; whereas, in the second part, I have gone whole hog with law, and I admit those without formal legal training may find it convenient to ignore. My style of writing is terse and pointed, but at times I have gone overboard like in one particular opinion on Aarushi murder, where emotions and logic intermingled in an expanded narrative. Righ...

Light : Philosophy

By: Ankur Mutreja

What is Philosophy? Is it the exclusive domain of those who dream in abstract? Or is it the manifestation of the struggle of those who practice in material? Does it originate in the minds of professors like a Ganges flowing out from the hair-locks of "Lord" Shiva? Or is it rustic and puerile, evolving into maturity through the experiences of common men. I started writing philosophy without actually knowing that I was writing one. To start with, it was an outlet to project my frustration in the form of writings. Pretty often, it carried abuses hurled at none in particular, but at the system through its agents. But I don’t know when those ramblings started getting matured into Philosophy and all puerility and abuses purified themselves on the way – a Ganges doesn’t become pure by its origin but by the treatment people give to it on its way. In my book “Writings @ Ankur Mutreja”, I included a section on my personal philosophy and thought nobody would be interested in reading it. But, fortunately, I have found some kind-hearted people, who have given me their valuable feedback. I am reproducing my philosophy below by selecting those top...

The Ideal Within : A Discourse and Hegemony Theoretical Analysis of the International Anticorruption Discourse

By: Anja Carolin Gebel, Dr.

The doctoral dissertation analyses the international anticorruption discourse by the World Bank, UNDP and Transparency International. It draws out implicit conceptions of an ideal uncorrupted society. While international anticorruption discourse is found to be broadly reflective of what can be called advanced liberal ideals of governing, the thesis enables an in-depth understanding of the manifold and complex discursive moves through which these particular ideals are constructed and advanced by the discourse....

"Overall, IAC discourse delegitimizes any social constellation and political project that involves a conception of human beings which differs from ‘rational and self-interested’. [...] These negations of different social structures and political projects are related to other negations, such as of non-positivist ways of acquiring knowledge and investigating corruption and possible counter-measures. In a political project that is structured consistently according to the presuppositions and findings of positivist, rational choice inspired research, any other ways of looking at the world [...] can only be risky and wrong and endanger the fight against corruption"....

Abbreviations Figures Acknowledgements Quotes Introduction 1 Corruption as a social construction – implications for an analysis of international anticorruption efforts The fight against corruption – an intrinsically good project? Positivist research on corruption – corruption as a fact After positivism – corruption as a socially constructed concept International anticorruption efforts as a site where corruption is constructed 2 A post-Marxist discourse and hegemony theoretical approach to the analysis of international anticorruption discourse A theory of discourse – a theory of society Hegemonic strategy, stratagems and other discursive logics The IAC consensus from a post-Marxist discourse and hegemony theoretical perspective Delimiting and analysing the discourse – ‘operationalisation’ and method 3 Creating the enemy Definitions, manifestations and locations of corruption Causes of corruption Social, political and economic consequences of corruption Subject positions Metaphors...

Neutrosophic Dialogues

By: Florentin Smarandache; Feng Liu

A book on the contrasts between the eastern Asian culture versus the western culture on topics such as education, medicine, science, and politics.

Is oriental culture a kind of science? There lies a crucial difference in that Western science seeks the exterior solutions outside the heart. However, our ancient sages illustrated that humans are an integral part of the universe, and all the phenomena never skip out of the heart. And very fortunately, many wise men did succeed in cultivating their hearts to testify to the profound truth. So our Eastern classics focus on our inner cultivation. However people, including the overwhelming majority of the Chinese, would regard such education as being an extra (to life or science). Please contact the corresponding Taiwan or Singapore websites, where there are plenty of English versions of texts and videos of Buddhism, to request the standard translation. “What is Dao (Tao)? It is the natural principle all over the universe, the natural order, the essentiality of nature. The great universe has its order and rule, where the education of ancient sages roots. Education stems from here, and a human being has to obey the natural principle –Dao. In our Chinese notion of the integral of humans and nature; heaven, earth and human are...

Stop… Before you read this book, I need to warn you. I’m about to make some arresting claims about the future of our country. I know this is a politically charged and emotional issue. My conclusions will not be easy for most readers to accept. Likewise, many of the things I am writing about will challenge people to re-examine what they believe about their country. Understand, I am only writing about the facts as I find them. And the facts about America tell a painful story about a country in a steep decline, beset by problems of its own making. I fear this publication will spark a tremendous amount of controversy. Many people will surely accuse me of deliberately writing inflammatory things to stir the pot and gain attention. That’s not my intention. I’ve gone to great lengths throughout my career to protect my privacy. I am speaking out because someone must. And I have the resources to do it. I am sharing these ideas with all who will listen because I know we have arrived at the moment of a long-brewing crisis. I am only drawing conclusions based on the situation as it stands. I am not saying these condit...

WTF! This is a Liberal Utopia!

By: Frank B. Thompson, III

Audiobook (Part 1) available - fbthompson3.com What would America look like in 2050, if the liberals ultimately prevail? Pushing discourse down to the same high-sounding, muddled thinking of the geniuses on 'the left;' through vapid, touchy-feely, non-erudite, irrational conclusions and illogical, logical sounding arguments. The book the publishing houses would never let see the light of day....

The year is 2020 when Professor Felix Schwartz, your typical, garden variety, liberal college professor, steps out in front of a Mack truck and the lights go out. Thirty years pass by, all the while Schwartz remains a walking vegetable and ward of the state. By 2050 the country has gone through some changes thanks to a dramatic shift in the makeup in the country's populace giving liberals (referred to as assclowns, moonbats, goofnads, or asshats) control over Washington. In that thirty years the country becomes the veritable paradise moonbats have long sought to create, but more resembling a third-world, banana republic where English is replaced by twenty-five variations of gang slang, no one gets beyond third grade, rioting and something resembling football with hockey sticks are the national pastimes. There is now a "Forever President," welfare moms have replaced small business, corn is the cornerstone of industry, and people drive around in either battery-powered, bubble cars, or Latino lowriders. While nonthinking, Schwartz is led around on a doggie leash, has become something called a 'pinball,' has names ranging from V...

When Power and Piety Collide : A Critical Analysis of Early Caliphate in Islam

By: Sayed Moustafa al-Qazwini

In our present era, it is most disturbing for many Muslims and non- Muslims alike to witness the escalating rise in sectarian violence between the Shia and Sunni followers of Islam, particularly in places such as Iraq, Afghanistan, and Pakistan. Some people, including Muslims, ask why the Shia and Sunni are violently murdering each other; is there something in the history of the Muslims that continues to spark such hatred and violence today; why does one sect accuse the other of heresy; and why is one sect of the Muslims considered as “mainstream,” while the other wing is branded unconventional and literally pacified? Unquestionably, seeded in the history of Islam is the answer - in particular, the political course that was taken following the death of the Prologue ii Holy Prophet and the way in which the early history of Islam was written. They say that history is bound to repeat itself and this is much more apparent today because the remnants and unconsciousness of Muslims in regards to their own history is affecting Muslims today. The account of the Muslims is not the classical historical case of not knowing th...

Understanding that the historical and political aspects covered throughout this book may be delicate for some; nonetheless, never is it meant to be as a means to jostle sectarian division - this is far from my intention. I have maintained judicious care in the manner of presenting this work, but it is my belief that in order for Islam and Muslims to go forward in harmony and solidarity, we have to have the courage to recognize the truth of our past and rationally discuss the matter in a dignified and scholarly fashion. When an injustice is done in the past against others, then it becomes incumbent upon the people of the present to acknowledge it and make amends. This needs to happen so that the Muslims can truly practice what Allah has intended for them - a religion of brotherhood, peace, and justice. Until the end of time, even the most sincere Muslims will disagree upon what they truly believe is the most correct path. However, while accepting that there will be disagreement, it is important to represent each school of thought accurately - as it represents itself, and as reliable and mutually agreed-upon historical...

The Art of Anti-War

By: Florentin Smarandache

The antiwar of our entire nation is defined as being the army-impeded forces, skirmishing shoulder to shoulder with the civilian population, with the purpose of defeating all non-aggressors, for securing our country’s slavery and dependency. The defeat in this battle is assured through a moral inferiority of our population - the right cause of this antiwar -, the lack of heroism of our state’s citizens, by applying an adequate blundering, using our geographical disadvantages, and the international public humiliation. ...

The battle and its non-goal. The battle is an ensemble of skirmishes of the subunits and units, which take place in a disorganized manner using armament and fighting techniques, for the expressed desire to enforce the enemy. The battle cannot take place on the ground, in the air, or on the water, in an open paradoxist cooperation with all-military denominations, and using their armament’s procedures with the goal of empowering the non-aggressor enemy. The battle is not the only way for obtaining the miscarriage. The battle’s goal is not the destruction or the capture of enemy’s groups, or the capture and holding on of critical portions of terrain. While in anti-defense, the defeat with fewer forces of the enemy’s superior forces would be done with our old-fashioned technique: ...

K's Bhoomika

By: Manohar Asija

Having lost her mother, and virtually rendered `orphan`, in the absence of `father`, a little girl Named Bhoomika, by dint of sheer circumstances, happens to reach a virgin teacher. Here, the `blessed opportunity for education` awaits her, as she is inspired and guided by this benevolent lady towards higher education. Once, she was offered a part-time job of `a reader for a blind class-fellow` of hers at Khadi Degree College, Guhahati: and she gladly accepted it. Of course, some nascent opportunities came to her, even in Delhi, when she was staying in a Working Women’s Hostel, while doing some odd jobs to support self, economically. But the travails of life also came her way; and she coped up with every sort of situation, by way of `fine-tuning` the responses from her brain and heart, every time, with an objective to attaining a quality decision from within. Having once been requested by very senior colleague to stay with one spinster Professor, during her illness, she served the lady so dutifully that the Professor persistently requested her to live with her till the young girl is married off. Having attained some extraordinary ...

"In fact, I had never spoken to her even a single word, though she continued to send me signals for initiating a dialogue with her. I had to go to fetch my daily quota of water from the water-tap, provided at the back of her tenement, for all the four segments, in the vicinity. Almost every time, we had to place our buckets or utensils, in a queue, while waiting for our turn. Being shy of passing through the front lane, while approaching the water-tap, I preferred to walk along the back of the segment, in our front. God knows, how she could spot me from such a long distance that I had come out of my room, with buckets in my hands. Quite often, I marked her busy in looking towards me with furtive glances, while waiting for her turn, as she would deliberately waste her time, simply to ignore the fact of my arrival there and would thus make room for me to place my buckets before hers.” .......... It pains him to recall his last meeting with that `unfortunate girl`, who was destined to spend a spinster's life and breathe her last, while resting her head at Bihari's knee, who kept caressing her forehead, in the presence of her trusted ...

Against the War : A Novel of the Vietnam War Era

By: Roland Menge

AGAINST THE WAR follows the intertwined lives of four friends, rowing team mates, who graduate from college at the height of the Vietnam War and struggle to make decisions about the war and the military draft. Two become involved in the war, one as a combat pilot and one as a medic. The other two of the four friends, in trying to avoid the war, become involved in the “war on poverty,” the anti-war movement, and the counterculture that arises from the anti-war movement. In the course of the four and a half years covered in the novel, the four men also meet and court the women who become their eventual spouses. These women become part of the story as they position themselves with respect to the war and the women's liberation movement. In the course of this, also, the eight young people of the novel find themselves within an ever growing phenomenon involving thousands of American youths like themselves reacting to the same far-reaching dynamics of the counterculture and the war. "Menge's book reminds me of both Theodore Dreiser and John Dos Passos. It's a vast panorama with enormous attention to detail." David Willson, Vietnam War F...

234. Morris is relocated from Sam Neua to a Lao village From Sam Neua, the group that included prisoner of war James Morris headed southwest, so far as he could determine from occasional glimpses of the sun through the canopy of leaves above the road on which the caravan was traveling. Then the shield of leaves dropped away briefly and Morris saw that the wagon was moving along on a road about 400 feet above a town with narrow streets and Chinese-style pagoda roofs. Some of the buildings were demolished and others were in flame. “That is Sam Neua, the actual town,” the third passenger informed. “Where was the camp then?” “Place called Xanthon. Just a few miles away.” “The damage here is from bombing?” “Yes, American planes.” “You’re a soldier?” Morris asked. The man was an American, Morris had already decided, based on the easy informality that he had learned set Americans off from other English-speaking people overseas. “No, I’m a clergyman. Catholic priest.” “Is that so?” “Yes. I’ve been working up in the mountains north of Long Thiueu for about five years. My name is Leonard Blair.” “Well, pleased to meet you, Father....

This short technical paper advocates a bootstrapping algorithm from which we can form a statistically reliable opinion based on limited clinically observed data, regarding whether an osteo-hyperplasia could actually be a case of Ewing’s osteosarcoma. The basic premise underlying our methodology is that a primary bone tumour, if it is indeed Ewing’s osteosarcoma, cannot increase in volume beyond some critical limit without showing metastasis. We propose a statistical method to extrapolate such critical limit to primary tumour volume. Our model does not involve any physiological variables but rather is entirely based on time series observations of increase in primary tumour volume from the point of initial detection to the actual detection of metastases....
